Alexander Robertson, IV, Esq.: Mr. Robertson recently won class certification for the homeowners of the Paradise Palms neighborhood in Las Vegas, Nevada in a PCE groundwater contamination lawsuit filed in Clark County, Nevada. The case, Voggenthaler, et al v. Al Phillips the Cleaner, Inc., Clark County Case no. A553784 involves the largest plume of PCE in Nevada. PCE is a common dry cleaning solvent. On September 17, 2009, the Honorable Allan R. Earl, Judge Presiding, ordered that the class action be certified on behalf of all homeowners whose homes overlie or are immediately adjacent to the plume, located in the shallow groundwater approximately 15 to 20 feet below the ground surface. According to the Nevada Department of Environmental Protection, vapors from the evaporating PCE plume beneath the homes has migrated up into the indoor air in some homes.”
