Jonathan is the managing partner at Robertson & Vick, LLP. He started his legal career as a trial attorney with the Office of the Solicitor, United States Department of Labor, where he was primarily involved with enforcing the Federal Wage and Hour laws and the Federal Occupational Safety & Health Act. While with the Department of Labor, he gained experience in litigating cases in federal courts as well as before the Administrative Law Judges.
Since entering private practice in 1990, he has used the "hands-on" experience he gained in the roofing and waterproofing industry in representing owners, general contractors and subcontractors in construction defect litigation. His practice also includes handling construction claims, delay claims and mechanics lien actions on behalf of owners and contractors. Further, Jonathan is experienced in handling insurance bad-faith cases, toxic tort cases, community association law, catastrophic personal injury and wage and hour cases.
His years working for the U.S. Department of Labor prosecuting Federal OSHA cases has helped him develop his experience in representing employers in matters before the California Occupational Safety and Health Appeals Board for citations issued by Cal-OSHA. He has also completed training for hazardous waste operations and emergency response standards in accordance with 29 C.F.R. § 1910.120(e) and 8 C.C.R. § 5192(e).
Significant Representations
• Johnson v. Vintage Petroleum, Ventura County Superior Court Case No. CIV 149 987 (Lead Case). Case involved an oilfield accident which resulted in 3 wrongful death cases and 3 brain injury cases. Mr. Vick defended Schlumberger Oilfield Services which was one of the 2 target defendants achieving a defense verdict for his client in the trial. It was one of the longest trials in Ventura County history lasting almost 9 months resulting in a verdict/settlement in excess of $8 million dollars against other defendants.
• Stonegate at West Hills v. Kaufman & Broad, Los Angeles Superior Court Case No. LC 048341. Mr. Vick represented the Stonegate Homeowners Association in a construction defect action. After settling with all but one party, the case proceeded to trial where the trial judge granted the defendant’s motion for non-suit. Robertson & Vick, LLP appealed this ruling and the Court of Appeal published a decision reversing the trial judge. The case establishes the legal basis for an owner to sue a subcontractor for negligence in a construction defect case.
• Doe v. Doe (Confidential). Mr. Vick represented a bicyclist who suffered a traumatic brain injury due to a roadway accident because a contractor had failed to pave a depression around a sewer cover in a street. The 51 year old man would need lifetime care. The case settled for $5.2 million dollars.
• Whetstone v. Schlumberger, Ventura County, Case No. RCV 24958.
Mr. Vick defended a wrongful death at trial in a case resulting from an accident on the Ventura Freeway where a tailgate fell off a truck and killed a motorcyclist. The decedent’s family was represented by Bruce Broillet of Greene, Broillet, Taylor, Wheeler and Panish.
• Robinson v. Doe. Joshua Robinson was a 19 year old male who was involved in a vehicle accident resulting in a traumatic brain injury and which left him a quadrapalegic. Mr. Vick defended the contractor and was able to successfully settle the case.
• Safe Plastering v. Roy Yang, Los Angeles Superior Court Case No. LC 040850. After performing a reconstruction on a home after the Northridge earthquake, the contractor recorded a mechanic’s lien against the home for extra work and unapproved change orders. The jury issued a defense verdict on all claims on behalf of the homeowner who was represented by Mr. Vick.
