Facts
Plaintiff bought a duplex in the midWilshire area. The city reports stated zoning was R3. After the sale, the Plaintiffs architect found the property had been downzoned to R2. The Plaintiff sued the sellers and both real estate brokers. The Court granted all Defendants' motions for nonsuit after the Plaintiff rested.
Plaintiff Claimed
the sellers breached the contract and misrepresented the zoning. The brokers were negligent.
Defendant Argued
it was reasonable to rely on the City's 9A report of residential property to confirm correct zoning, and that the property was worth the price paid as is.
